Donald Trump’s initiative to transfer transgender prisoners to male facilities has ignited considerable debate.
However, one inmate is countering this action with a legal challenge.

On Sunday, Maria Moe a transgender woman filed a federal lawsuit in Massachusetts challenging an executive order that Trump signed into law on his first day in office.
Under this order, the Federal Bureau of Prisons (BOP) is required to house transgender inmates in accordance with the sex assigned to them at birth.

Additionally gender-affirming medical care is prohibited in federal facilities.
Supported by the National Center for Lesbian Rights GLBTQ Legal Advocates and Defenders and Lowenstein Sandler LLP the lawsuit argues that the order violates the Fifth and Eighth Amendments and goes against accepted federal rulemaking procedures. .

“The Order directly targets transgender Americans by attempting to deny them legal recognition under federal law and to strip them of long-established legal protections,” the complaint reads.
Moe, who has been recognized as a woman since middle school and is treated as a female in prison documentation, was reclassified as “male” subsequent to the order.

Because of this change, she was moved to a specialized housing unit and informed of her impending transfer to a men’s prison, a decision she finds herself powerless to contest.
The lawsuit contends that the order’s timing, content and context reveal discriminatory intent.

It substitutes the Obama-era guidelines that prioritized the safety of transgender inmates with policies based on what the Trump administration refers to as “biological truth.”
The Justice Department has not issued any comments regarding the lawsuit; however, this situation raises significant concerns.
Although the implications are serious, the response from the Justice Department remains pending because they have yet to address the matter.
