Supreme Court allows Trump to implement transgender military service ban for now

The Supreme Court ruled Wednesday that the Trump administration can move forward with a ban on transgender military service members for now, lifting a lower court injunction against the policy.

In a significant development, the U.S. Supreme Court ruled today that the Trump administration can enforce a controversial ban on transgender individuals serving in the military, overturning previous blocks by lower courts.

The decision, announced in a brief, unsigned order, allows the policy to take effect while legal challenges continue to unfold.

The ruling stems from an executive order issued on the first day of President Donald Trump’s second term, which revoked a 2021 order by President Joe. Biden that had permitted transgender service members to serve openly.

A subsequent order from Trump, issued a week later, stated that “adoption of a gender identity inconsistent with an individual’s sex conflicts with a soldier’s commitment to an honorable, truthful, and disciplined lifestyle.”

The Defense Department implemented this directive in February 2025, mandating the removal of transgender troops from military service.

Lower courts had previously blocked the ban, arguing it lacked evidential support and violated equal protection principles under the Constitution.

However, the Supreme Court’s decision—met with dissent from its three liberal justices, Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson—did not provide reasoning, as is typical for emergency applications.
