Cheating on your spouse is no longer a crime in New York, after a 1907 law was repealed

Infidelity in marriages and relationships is no more a criminal offence in New York.

A 1908 law was repealed after Governor Kathy Hochul signed a bill that made this ruling possible implying that cheating on your spouse is no more a crime.

Initially about a few weeks ago, the state law was applied to effect that arrest of a married man and a 25-year-old woman.

It is revealed that the law which dates back to 1907 was found antiquated therefore it become very challenging to get it enforced.

“While I’ve been fortunate to share a loving married life with my husband for 40 years — making it somewhat ironic for me to sign a bill decriminalizing adultery — I know that people often have complex relationships,” she said.

“These matters should clearly be handled by these individuals and not our criminal justice system. Let’s take this silly, outdated statute off the books, once and for all.”

Technically, the New York law applied when a person “engage(d) in sexual intercourse with another person at a time when he has a living spouse, or the other person has a living spouse.”

Hitherto, New York was one of the seventeen states that found adultery a criminal act and it has now officially become the fifth state to have repealed such a law since 2015.
